5.1 Bonafide gifts up to a value limit of Rs.10,000/-, imported by post, are exempt from Basic and Additional Customs duties vide Notification No.171/93-Cus., dated 16-9-1993. Further, only those items can be imported as gifts, which are not prohibited for importation under Foreign Trade (Development and Regulation) Act, 1992.
The Government has exempted gifts items received from foreign country to persons residing in India from the whole of custom duty under Foreign Trade Act. In the present scenario, import of goods up to the value of Rs. 5,000/- is allowed as gift, duty free. This exemption is allowed only for bonafide gifts imported by air or post. For the purpose of calculation of this value of Rs. 5,000/- the air freight or postal charges paid are not added. It is important to note that the value of Rs. 5,000/- is the value of the goods in the country from where the goods have been dispatched. The sender may not necessarily be residing in the country from where the goods have been dispatched.
Who can send the gifts? Any person living abroad can send a gift to an individual living in India. There is no specific restriction that only relatives can send the gift items. Business associated, friends, relatives, companies or acquaintances can also send the gifts to the people living in India.
Custom Clearance Permit of Imported Gifts Import of gifts items, which is freely importable need no custom clearance permit. However, there are certain gift items that are not freely importable. In such a situation a special permit is required by the custom authorities. The main objective of the custom clearance permit is to allow the import of gift items which is other wise restricted or prohibited by Government of India for the use of charitable, religious or educational institute registered under a law or approved by the Central or State Government.
Application Procedure for Custom Clearance Permit (CCP) An application for the grant of CCP for an item which is otherwise restricted or prohibited in the ITC-HS Classification may be made to Director General of Foreign Trade supported by the following documents.
Applicant's request on his compay’s letter head or plain paper duly signed with all the details.
Donor's letter in original duly signed and indicating his name, address and the purpose of offering gift.
Bank Receipt in original in duplicate/ Demand Draft / EFT details towards payments of application fee at the prescribed rate.
Self certified copy of proforma invoice.
Any other relevant document which applicant would like to enclose.
I purchased a few large sized silver certificates ( face value 1& 5 dollars ), meaning old defunct notes of USA for my collection. Initially they came by registered post free of any duty. Recently they (Indian customs) have been charging heavy duties in several thousands of rupees. If collection of old stamps nad first day covers are exempt, what about old defunct American notes of say 1881,1891 and 1899 ? I am in such a fix that since I have paid for 13 notes notes for my collection from different American dealers registered on e-bay,I have perforce to pay these huge amounts in rupees. I am at a total loss of words. After these 13 notes arrive, I am going to say bye bye to e-bay, for that matter to every note dealer. Rointon
i give up. i have a pentax DSLR on which i was using kit lens and an old SIGMA DL lens, i thought of some bargains whic turned ineffective 1) brought a sigma mini wide 28mm old lens described as pentax mount, it turned out to be ricoh mount with ricoh pin, which i realised once it jammed my camera got a refund. 2)brought a old/used promaster 19-35 which is yet to arrive, no tracking available though had requested it to be registered for tracking to be there over month. 3)read a lot of tokina at-x pro thus thought of brought a tokina AT-X pro ver1 28-70/2.8 tracking vanishes at customs over 15/20 days guess this is also lost- its on EMS/Speed post. never had this issue earlier when i brought old laptops for parts for myself. i think i give up and feel that ebay is ok for small ticket items or for parts unless one is a trader and has appropriate registration.
Today I have to pay Rs 2934/- to customs to collect my camera flash The camera flash value is Rs.5200/- only. Indian postal department & customs collecting too much customs duty...Never purchase anything from overseas via ebay.
Please dont buy anyhting from abroad....thats all i have to say.... until our government has some concern about us indians..... paying unnecessary customs duty....
I bought a one mobile pouch, tablet cover, one usb adapter, and a micro sd adapter which cost me around 1400rs... after a few days i got a letter from the customs stating i have to send them the invoice and the details of the products...which was send and when there was no reply i called them and they told me to send them my credit card statement for that purchase which was also done. when the product came to my house (after 2-3 months) the postman told me that i have to pay a duty of 650rs.... i checked with the customs and they told me that i have to pay 36% duty for any product i buy from abroad........... Its killing if i say....
contact customer support and go to resolution center http://resolutioncentre.ebay.in/ and open a case against your seller. you will get your money back for sure.

to all the guys who post here asking for how much the customs duty is for the items the bought, guys u should be worrying about the customs BEFORE u buy the item not afterwards ( real STUPID i should say). I went through Indian customs website, the excise/customs duty varies a lot, depending on TYPE of item(not all items have same customs duty), its weight and value shown in the customs declaration form by shipper/seller.
MOST sellers from US and Europe DONT break rules and label an item as a gift (but a few do i guess), so better confirm with the seller before u bid/buy for any item. And India customs is veryyyyyy corrupt and ineffecient, most of the time if u get an item from abroad by mail without any hazzles/issues u r LUCKY...and usually no one is going to contact u from customs to inform u about any problem/issue with the package u received, ( unless it is high value item or some serious violation like banned items etc) they know that anyways after waiting for sometime u will try to contact them yourself, I know this from personal experience, but hey it was my own experience, maybe people here will have a different story to tell

Bonafide commercial samples can be imported through courier provided the said samples are being received free of cost (see Import of Samples). Similarly, gifts from persons abroad upto the value of Rs. 5,000/- and all the life saving drugs and equipments which are not chargeable to any duty at present (see Notification 20/99-Cus) can also be sent to India through the courier mode.
ebay is pathetic: I bought a Bajaj iron through e-bay paisa pay ID 180767857119. The seller kept delaying the delivery. suddenly i found the paisa pay status as treated delivered.The seller sent a defective item after one month. When i approached ebay they asked to reship the item back to the seller which i did on 9th Feb. Till day I am yet to get any status from ebay. the customer help desk at ebay is pathetic. It takes hours to get into a operator and even they kept repeating the same thing without any help. Transacting with ebay is frustrating and i will never advise any body for the same. There are other portal which provide better service.
I m into buying a used phone approx 60$ .I would like to ask how to declare the item is used, will that be done by seller while shipping and printed on the invoice or some other proof is required? I have heard that in case, the item is charged, they do so on the depreciated value.
Hi everyone. You can just google Indian custom fees. But for example in my country (Ukraine) they add 45% to a price for every item above 200$. So when i buy something expensive, I'm asking seller (before bidding) to indicate lower amount in the shipping invoice, like 180$ instead of 700. I've done this several times and never got any issues. One more thing. Item being shipped via FedEX may be revalued by its staff disregarding what is written in the invoice, so in order to avoid possible problems i prefer to use regular post services. Peace

If it was Global Ebay you bought from, then you might have to wait for a very very long time for the item to ship (if at all they ship it). Customs will not be a problem though.
In case of direct purchase from ebay.com, you might have to pay Customs and in states like West Bengal and U.P. there will be a few more problems like from the sales tax dept.

Hi, I have purchased a camcorder from USA on ebay.com for $5.5+ shipping $45.5. the seller shipped the item promptly after making the payment thru paypal.
Now i have received a show cause notice from customs department, chennai stating it is a restricted item and give the explanation why penal action cannot be taken? more over they have assessed the value of the camcorder for Rs.9000/-.
What should i do now? cos lot of people from india might be buying from other countries as the items are available at cheaper prices.
If you are in other Cities other than WEST BENGAL then you wont have any trouble with the Postal Custom House.
If the item is used and valued lower then the Customs would only charge about 20 to 30% of the value as Custom fees.
I wont recommend GEB as they overcharges (shipping, duties, etc) and they are very very slow and even you wont be able to know about your order status as there is no one to reply to your queries. You would save money, time if you order directly from the seller on ebay.com
I have very sad experiences with the GEB and have discontinued using them.

Hi Guys, Recently i have bought a Nikon FE2, a 35mmFilm SLR camera from U.S.A eBay seller for $209 plus shipping charges another $32. By the time it reached my address, postman came up with a customs note asking for Rs.2,999. The camera wouldn't fall under electronics category and on top of that, its nearly 26 year old used camera. I didn't take the camera after i saw the custom duty note. I got atleast four other cameras earlier from international sellers and i had never this kind of a problem even with expensive camera than this. Right now its still at the post office. Can any one guide me to get out of this irrational customs duty?
